1. INTRODUCTION TO PRIVACY POLICY
Physique Improvements, LLC (the “Company”) is committed to maintaining the confidentiality,
integrity, and security of any personal information about the Company’s clients and end-users.
To demonstrate this commitment to protecting your privacy, the Company has developed this
Privacy Policy (“Privacy Policy”), which describes how the Company collects, uses, discloses,
and protects your personal information through its online products and services, including but
not limited to online training programs, consultation services, and digital communications
(collectively, the “Product”).
(a) TERMS OF USE
This Privacy Policy, together with the Company’s Terms of Use (“Terms of Use”), governs your
access to and use of the Product, as owned and operated by Physique Improvements, LLC, a
limited liability company having its registered address at 925 Gabriel Drive #106, Greenville,
NC 27834 (referred to in these Terms as the “Company”). Terms capitalized but not defined in
this Privacy Policy have the meanings set out in the Terms of Use.
“You,

” and “Yours”
refer to you, the client or end-user, as defined in the Terms of Use.
(b) CONSENT AND AGREEMENT TO BE BOUND(i) Consent Provided by Continuing Use. By accessing and/or using the Product, you agree
to all terms and conditions of this Privacy Policy and the Terms of Use, which are incorporated
herein by reference. If you do not agree to all the terms and conditions of this Privacy Policy and
the Terms of Use, please do not use the Product.
(ii) Consent Through Digital Platforms. There are certain types of device or application data
that the Product cannot access without your consent. If the Product is distributed through a
digital platform or marketplace, that platform will notify you when permission is required to
access specific data and will allow you to decide whether to grant such permission. You further
agree to abide by all terms required by any digital distribution platform so long as those terms
do not conflict with this Privacy Policy or the Terms of Use.
(iii) Changes Requiring Consent. If material changes are made to this Privacy Policy or to the
Product that alter how your personal information is used, the Company will notify you in writing
or by electronic means and will obtain your consent for any new purposes not previously
identified.
(iv) Changes to Your Consent. You may update or withdraw your consent at any time by
contacting the Company as described in Section 3 (Data Management).
(c) CONSENT TO COLLECTION AND ANALYSIS OF INFORMATION YOU PROVIDE TO US
(i) Specific Consent to Collection of Information. By using the Product, you consent to the
collection, use, and disclosure of your personal information by the Company in the manner
described in this Privacy Policy. You may choose not to provide certain information, but doing so
may limit access to certain Product features. For example, your name and email address are
necessary to complete registration.
(ii) Consent to Receiving Communications. When you sign up for an account or consultation,
you consent to receive administrative or technical emails from the Company and occasional
newsletters related to Physique Improvements programs and services. You may opt out of
promotional emails at any time by following the unsubscribe link provided or by contacting
info@physiqueimprovements.com, though the Company may still contact you for
administrative purposes.
(iii) Communications in the Event of a Breach. In the unlikely event that the Company
believes the security of your personal information may have been compromised, and where
such breach creates a real risk of significant harm, the Company will notify you by email or other
appropriate means in accordance with applicable law.
(iv) Company Will Never Request Confidential Information by Email. Physique
Improvements, LLC will never send you an unsolicited email asking for passwords, payment
card numbers, or similar confidential data. Please do not act on such emails, as they may be
fraudulent.(d) AMENDMENTS TO THIS PRIVACY POLICY AND COMPLIANCE WITH LAW
The Company may amend this Privacy Policy at its sole discretion at any time. Any changes will
take effect on the date posted or as otherwise required by law. The Company will notify users of
any material changes by email or by a prominent notice on www.ericdunston.com. The
Company will review this Privacy Policy periodically to ensure ongoing compliance with
applicable laws and best practices.
(e) DISCLAIMER
If you choose to access or use the Product, you do so at your own risk and are responsible for
complying with all local laws and regulations. The Company may limit the availability of the
Product to any person, region, or jurisdiction at any time in its sole discretion. This Privacy
Policy does not cover the information practices of other companies or organizations that
advertise or link to the Company’s services.
(f) MISCELLANEOUS
If any provision of this Privacy Policy is held invalid or unenforceable by a court of competent
jurisdiction, the remainder shall remain in full force and effect. Section headings are for
convenience only and do not affect interpretation.

Physique Improvements, LLC (“Company”) provides notice that information about you is
collected when you first register for or access the Product. Section 3 (Data Management)
explains how the Company stores and manages that information, and Section 4 (Data Usage)
describes the purposes for which it is used, processed, and shared with third-party service
providers who assist the Company in delivering its services.
(b) Collection of Personal Information
When you use the Product, the Company stores certain information that you voluntarily provide
as well as limited information collected automatically, including:
(i) Registration Information: Your first and last name, email address, and any other contact
details you provide during sign-up or inquiry.
(ii) Technical Information: Data such as device type, operating-system version, browser type,
IP address, connection speed, and other technical identifiers used to maintain platform
functionality and security.
(iii) User Preferences Collected Automatically: Information gathered through cookies,
session identifiers, or similar tracking tools that record how you navigate or interact with the
Product.
(iv) User Preferences Supplied by You: Settings you choose within the Product, such as
language, time zone, and preferred communication methods.

feedback you upload, post, or share through the Product, including forms, check-ins, andcommunications within Company-supported platforms such as Trainerize, QuickCoach, or
Entresoft.

secure third-party processors such as Stripe or PayPal. The Company does not store full
credit-card numbers or banking credentials.
(c) Methods of Collection
(i) Registration Forms and Onboarding: Information you provide during account setup,
consultation scheduling, or participation in Company programs.
(ii) Integrated Platforms: Data received from affiliated service providers—such as Trainerize,
QuickCoach, Entresoft, Stripe, or PayPal—required to deliver coaching, scheduling, and
payment functionality.
(iii) Communications with the Company: Emails, messages, or other correspondence
exchanged during consultations, client check-ins, or support interactions.
(iv) Analytics and Cookies: The Company may use cookies, pixel tags, or similar technologies
to improve performance and analyze usage. Cookies are small data files stored on your device
that record browsing activity and session details. Most browsers accept cookies automatically
but allow you to disable them through settings. Disabling cookies may limit some Product
functions.
(d) Processing of Collected Information
All collected information is processed to provide, improve, and personalize your coaching

3. DATA MANAGEMENT((a) Storage and Retention of Information
Physique Improvements, LLC (“Company”) maintains administrative, technical, and physical
safeguards to protect your information against unauthorized access, loss, misuse, disclosure, or
alteration. Information collected through the Product is stored electronically in secured systems
maintained by the Company and its authorized third-party processors, including Trainerize,
QuickCoach, Entresoft, Stripe, and PayPal.
Your personal information will be retained for as long as reasonably necessary to:

Comply with applicable legal and financial recordkeeping obligations; and
Resolve disputes and enforce agreements.
When data is no longer required for these purposes, it will be securely deleted, anonymized, or

access to the Product may be limited or terminated.

(a) Purpose of Collection and Use
Physique Improvements, LLC (“Company”) collects and uses personal information solely for
purposes consistent with the operation of its fitness-coaching and consultation services. The
primary objectives include:
(i) Providing personalized fitness, nutrition, and wellness coaching;
(ii) Managing consultations, scheduling, and progress tracking;(iii) Processing payments and maintaining accurate account records;
(iv) Communicating with clients regarding program updates, performance tracking, and
administrative matters;
(v) Maintaining security and integrity of the Product and related systems; and
(vi) Complying with applicable legal, tax, or regulatory obligations.
The Company limits the use of collected data to what is necessary for these stated purposes
and will not sell, rent, or lease personal information to any third party.
(b) Disclosure to Third Parties
The Company may share limited personal information with trusted third-party processors who
assist in the operation and delivery of its services. These parties perform specific business

Authorized third parties include Trainerize, QuickCoach, Entresoft, Stripe, and PayPal. Each
third-party processor is bound by a contractual obligation to maintain confidentiality, implement

Physique Improvements, LLC (“Company”) engages a limited number of third-party
service providers (“Processors”) to assist in delivering and maintaining the Product.
Each Processor is contractually obligated to implement appropriate technical andorganizational measures to protect personal information and to process such
information only under the direction of the Company.
The following Processors currently support the Company’s operations:
1. Trainerize – Provides online coaching, training-plan delivery, client
communication, and progress tracking.
2. QuickCoach – Provides online program delivery and communication features for
client management.
3. Entresoft – Provides administrative and client-relationship management tools.
4. Stripe – Provides secure payment processing and billing-related services.
5. PayPal – Provides secure payment-processing functionality for client
transactions.
The Company may update this list periodically as service relationships change. Updates
will be reflected in the latest version of this Privacy Policy posted on
www.ericdunston.com.
All Processors are required to:
